I hope it's not just a mistake and someone has forgot to tell them that they are not supposed to be transmitting on freeview , we will just have to see if it continues to be shown in the coming days . If it is the Dutch licence that protects them from the new Ofcom ruling's i wonder what other things this Dutch licence allows them to do , i have never seen it published any were what the Dutch licence rules actually are . It also looks like the Earlybird show chan 98 will also continue to be broadcast on freeview .

Nope - they're still there, but showing 'No Event Information'.

There's no reason why it shouldn't. It isn't an adult chat channel, so the pre-midnight ban wouldn't affect it anyway.

I shouldn't think so. I would imagine that the new rule is binding on Freeview itself rather than on the individual broadcasters.

I wouldn't think that even BS's Dutch licences would get them out of this one. On the other hand, 'babestation' wouldn't answer my query in the subject, so who knows . . .

I really must learn to read and digest more thoroughly. Quote from Ofcom's Regulatory Statement about the new babe channel rules:

Five argued that Ofcom’s proposal “effectively singles out” Five and Partyland, as “the impact of it would be to force Partyland off Freeview and prevent [Five] subletting our capacity to adult chat or psychic TV channels in future”. Meanwhile, “the potential for consumer harm and offence would be largely unaffected – three other Participation TV channels similar to Partyland would continue to be broadcast on Freeview as they are licensed in the Netherlands and therefore outside Ofcom’s jurisdiction; while Freeview channels transmitting editorial material that may well be as offensive to viewers are outside the terms of Ofcom’s proposal”.

While this specifically refers to the original proposal to remove the channels completely, it must equally apply to the timing amendment.

One of the suggestions made in Ofcom's recent consultation regarding the babe channels was that 'book-end' markers should be placed before and after the adult section of the EPG so that channel-hoppers using the up and down buttons would be fore-warned that they're about to enter the adult section. Channels 92 and 99 appear to be performing that function.
Early Bird was still on ch98 this morning. I watched Fernanda around 8.30am for a few minutes.

Yes that's what i thought and i posted my thoughts on the matter on here , but some one posted on here that because it is a premium rate phone number Ofcom could ban it being shown after 5.30 am and before 12am on freeview , but glad to see it is still transmitting , it's the best daytime show there is on Sky .

Surely "book-ending" is a complete and total waste of time? bladewave Won't it draw more attention than before?

Also a waste of 2 channel spaces, which I expect you'll tell me aren't technically wasted, but still, you know what I mean.

Could we have "book-ends" to warn us when we're going to watch ITV/Channel 4/you name it Rolleyes I think there are many so-called proper channels which are doing far more harm than BS etc
