Under section 319(4) of the Communications Act 2003 , the Ofcom must have regard to-
(a)the degree of harm or offence likely to be caused ...
(b)the likely size and composition of the potential audience ...
©the likely expectation of the audience ...
(d)the likelihood of persons who are unaware of the nature of a programme’s content being unintentionally exposed, by their own actions, to that content;.

Since the transmission was a brief freeview in an otherwise encrypted channel that few people would be routinely flicking through, and freeviews repeat the same recorded clips ad nauseaum, it would be interesting to see what assessment Ofcom made as to the likely size and composition of the audience, their expectations, and the harm or offense that audience would be likely to suffer. Most of the time casual viewer would just see a blank screen.

A good indicator of these factors is the volume of actual complaints generated.

Clearly Ofcom is out of synch with the publics percetion of offence. Judging by the above its football the people find offensive.

I agree that this is partly the channel's fault for never sticking up for themselves and letting the Ofcunts do what they want. They should have complained to lawyers or the government about Ofcom's abuse of power a long time ago but they don't seem bothered about being constantly shit on which means worse & worse shows for the viewers

I agree with all of the above - if it was necessary to be a member to view the content then it may go some way to avoiding the use by Ofcom of these threads.

Wouldn't it be wonderful if all the lazy, ineffectual whingers on these Ofcom threads actually shut up farting in the wind on here and maybe did something useful like lobbying Ofcom and their MPs instead?

As long as only a couple of people actually do something official in the appropriate direction, then you won't be surprised if Ofcom falls over laughing when they read these threads in here.
