Hi Eccles thanks for your reply mate, i work in the electrical industry and we've just switched over to Digital, I don't no mate, I just feel the general public have kind of accepted the Adult section being on there, and it seems there not bothered. Now I might be wrong and it's only my opinion, but Ofcom seem a lot more comfortable with having the Babe channels on freeview than SKY, why is anyone's guess.

I don't think any babe channel transmitting on freeview since Bangbabes had their freeview licence revoked last year has had any Ofcom fines or in breach rulings made against them , even with a potential larger audience babe channels on freeview don't seem to get the same amount of Ofcom attention as Sky channels , RLC/Playboy have received plenty of fines and in breach rulings ,as have the Sport xxx chanels , non of these 2 channels are on freeview , Elite has had plenty of complaints but non as far as a know were from the freeview channel, i don't think TVX got any complaints when it transmitted it's own shows on freeview but it had some for it's Sky channels , the Cellcast channels with a freeview Ofcom licence don't seem to have Ofcom problems , so even though babe channels on freeview can be seen by a potentially larger audience it is the Sky channels that get the complaints , this is probably because the vast majority of complaints are not from the general public but by Sky babe channels complaining about each other to Ofcom , this scenario has probably not yet spread to freeview .

Great post Mystery, if that be the case, and as you've said as far as you're aware there hasn't been a fine for the babe channels on freeview, surely it would be in the other babe channel interests to leave SKY and jump ship to freeview. I agree with you a lot of the complaints seem to be between rival producers complaining to Ofcom, in theory giving Ofcom free ammunition, I guess if the producers had there time back, I think they would've kept there mouths shut.
It's definitly a talking point, if freeview seems the way to go and it seems Ofcom seem ok with it then i say " What's the problem" All the babe channels wave bye bye to SKY freeview here we come.

You may have hit the nail on the head. Its getting like the top shelf at the newsagents. Local village newsagents run by elderly retired couple and their daughters / strick Asian family / whatever and patronised the everyone from the Vicar to local kids has a top shelf with explicit sexual content and noone bats an eyelid.

Some thoughts on Freedom of Information responses

Ofcom ref 1-1826162​59 / Ejaculate
Ofcom introduced a specific rule banning anything that remotely looks like ejeculate. When questioned they justified it on the basis of many complaints. When challenged they said there were 66 complaints over 5 years. When pressed it turned out that only 2 were about Adult channels and only 1 complaint out of 66 was upheld.

53 complaints were against PSBs (BBC, ITV, Four, 5). 5 were General channels. 4 were Film/Movie channels. 1 was an advert. 2 were Adult channels. So the bulk of the complaints were against the so-called 'Respectable' channels but Ofcom takes no action against them.

19 show types were documentaries.
14 were sex education (not surpising).
17 were comedy. Perhaps spunk is a suitable subject for laughs though I can't recall seeing that many jizz based sketches.
Just 2 were drama or comedy drama, so much for dramatic justification.
1 was general entertainment and 4 were film.
1 was current affairs news.
1 was a music video and 1 a trailer.
2 were adult chat.
2 were advertisments.
1 was a cartoon and 1 a children's show.
To some extent these reflect the nuroses of different viewer groups - a parent watching a kids show with their toddler is going to be more sensitive to innuendo than the same parent watch a hard hitting cop show late at night.

Timing was 13 between 8am and 8pm, 46 8pm-midnight, 5 between midnight and 5am, just 1 between 5am and 8am, and 1 unspecified (an advert).

Clearly the bulk of complaints were directed to the big public service broadcasters for documentaries and sex education closely followed by drama, between 8pm and midnight. Personally I don't recall seeing a single drama that had anything looking like ejaculation.

This covered a 7 year period from 2004 to 2011, so complaints average a bit under 10 per year.

There were a 24,462 complaints total in 2010/11, meaning ejeculation accounted for 0.04% of complainsts or about 1 in 2500. The figures are of course much lower if referring to upheld complaints.

Ofcom has introduced a rule with no rational basis. The volume of complaints does not justify it. In most cases it is very clear that the substance in babe shows is not ejaculate but is in fact spit, skin creme or similar. Ofcom rejected 65/66 complaints (98.5%) and upheld just 1 (1.5%) and that 1 was for a show after the rule was introduced. Before that they rejected 100% of complaints.

Ofcom decided they did not like something and announced a ban with no rational explanation, no prior notice and no consultation. They hide behind BCAP advertising rules but also try to claim a long history of complaints.

It's not fair and impartial.
