The Sky fee is never paid late because it has to be paid in advance. Sky invoice quarterly 15 days before the quarter begins and the fee has to be paid within 14 days of the invoice, which therefore gives Sky a clear day in which to remove someome from the EPG for non-payment.

Even it it was possible to pay Sky late without being removed from the EPG it would be none of Ofcom's concern anyway. There is no obligation in the broadcast licences used by Studio 66 to be on the Sky EPG. In fact there is no obligation on Studio 66 to even broadcast anything.

As for the Freeview fee, does this even exist? The basic Freeview EPG listing that Studio 66 use is a free service and therefore does not need to be paid for. Again, non-payment of such a fee (even if it actually existed) would be beyond Ofcom's remit and none of their concern.

To be clear, Ofcom can warn or fine a broadcast licence holder for various reasons, but not for being absent from an EPG and not for failing to pay for such services. The only payment that Ofcom stipulate a licence holder must make is the annual licence fee payable to Ofcom itself.

The only occasion on which Ofcom can warn a broadcast licensee over financial matters, other than the non-payment of Ofcom's own fee, is when a licensee goes into administration. In such an event Ofcom can issue a formal warning to the broadcaster or simply revoke the licence.
