so if you have different view on internet to the one on shown tv, ofcom can use that against you? if so they are going beyond there remit. posters of vids should state weather this was shown on tv or only on webstream.

Admin, is correct on this. I would be very surprised, if Ofcom don't class this forum, as one of their chief sources of information, in regards to the babes channels. I'm not sure about whether they could use anything as evidence, as they can not verify it's validity. But certainly they will utilise an invaluable source of information, such as this. After all, the channels themselves regard this forum, as the definitive source of information & material on them.

As for the comment, as to whether they have any control over the Internet. Only as far as the information on websites, that appear on our TV screens. They have no control over what the website itself can do. Only what it can advertise on TV.

If OFCOM didn't use this forum for evidence they wouldn't be doing their jobs in truth. *spits*

Anyway onto a happier subject - Natasha Marley. She does stuff for James Bertoni and has made at least one vid with Michelle Thorn so she must know several of the bang Xplicit babes, any chance of getting her signed up. She'd be great with Dannii or Lucy I'd wager.

Not if you tell them it was webstream only. And if you send in a tape of the TV broadcast in question, as you are required to do, then you will have offered evidence to show it was webstream only.

possibly....however, it is highly unbelievable they would make a legally contestable (is that even a word) claim based solely on material posted on an internet forum. The chances of tampering with the material are too great. However, direct recordings are a much more solid evidence in any legal proceeding. Thus the requests for recordings and keeping evidence as means of compliance.

If its a genuine problem then perhaps posters should leave out essential information that would help Ofcom. Dont give the broadcast time. Or channel number. Even better delay a day or so before posting.

Ofcom can perform spot compliance tests, asking for a 1 hour sample for a time that they choose, and they can investigate specific complaints, but only within reason. They cannot say "send us your dodgey stuff for 2am Tuesday, no hang on, make that wednesday on your other channel, oh, we really meant 11pm and 00:30, or could it have been 1:15 ..."

Its called a Fishing Expedition, and there are legal rules against it.

I think the point mrmann was originally making was that Ofcom get enough tip-offs from this site to warrant them asking the channel for the recording. I don't think he was suggesting Ofcom use evidence directly from here to process a fine.

If a post is dated 3rd November 2010 and reads something along the lines, "Did anyone see Bailiey with her twat out on 954 last night?" Ofcom can then make up a complaint and request the recording for 2nd Novmber 2010. Once they have the recording, they can use it against the channel in question.
