Sadly I'm not surprised that Elite have copped it.Michelle Thorne went through a stage of regularly going on mic and talking filth and to a lesser extent so did Charlie O as well.Great to have them doing it as opposed to having to phone them but the rules are the rules and they've broken them.Crap and stupid of course but I was surprised at the time that no-one at Elite thought to tell Michelle & Charlie to tone it down.Yes it'll get you extra callers and viewers but is it worth a fine in the long run??And as already surmised here is probably the reason why Michelle left.Could also be that she refused to tone it down in which case Elite were going up a bit of a blind alley anyway.

They didn't tell them to tone it down, because apparently they were allowed to swear. First they were allowed to swear, then they weren't, then they were again, and now they aren't! I don't like swearing, as it's a bit forced and annoying when overused like with Michelle, but I don't see a problem with the women saying an occasional swear word, as long as it's in moderation.
So basically theyre in trouble for language, not nudity. Frank Skinner, Frankie Boyle, Jimmy Carr and Lee Evans had better beware. And South Park. Dont tell me that nothing in their acts is gratuitous.
Unfortunately, I'd say about 90% of all complaints made to Ofcom probably come from rival channels. Sad

I think it's about time Ofcom started taking a tougher stance, and saying that no complaints from rival channels will be upheld, as the person complaining cannot be without bias.

As for the complaint being about graphic language of a sexual nature. Then I would say it's in context of the show being broadcast.

Whereas a comedian like Chubby Brown, who can say all the same words used it the above complaint, and worse. And use them totally out of context. Yet his show is classed as legal.

The current regulatory system is a farce, and corrupt as hell.
I just read the OP and I'm scandalised. I may have to seek some counselling and possibly compensation.

What a bunch of fuckwits, I can fully believe that a rival station would be in a vexatious complaint sadly. After all who else is watching that might complain?
Does anyone know if a video of this was posted on these boards? I've tried looking through Caty Cole's thread around that date but it's not there (assuming it was Caty) and I can only find a discussion thread for the Elite 2-4-1s.

Fair point. How come it is against the rules for a sex channel to use words late at night on a lockable channel, but perfectly OK for Ofcom to use exactly the same words on a website with no adult verification accessible by children at any time of day? Because they put up a warning about offensive comment?
No, they dont accept that from the channels.
Because its not for sexual arousal? No, I bet someone is whacking off to the dirty talk and descriptions in the Broadcast Bulletins, specially as they make it sound sexier that it was with repeated detailed descriptions of clothing etc.
Oh, its in context of a regulator, so thats OK then. Not.

Hmmm. If complaints come from rival channels that blows a hole in the argument about exceeding viewer expectations. The viewer is a porn start or producer.

For crying out loud, Elite and Bang, get yourselves a decent lawyer and argue your case in detail. Give specific rebuttals, not "similar to other shows" but "similar to XYZ on the BBC on date". Get Ofcom to publish every case where Babe shows have NOT been found in breach -they have to under he Freedom of Information Act - and argue similarity (or inconsistency).

And argue that it is against the British legal system and European Convention of Human Rights for a case to be decided by the same people who bring it. If Ofcom prosecute then the decision should be made by an outside independent body.
Full disclosure of the source of the complaint (but not the actual name of an individual) should be manditory

I'm not saying you will find this particular show, as only a fraction of them were ever posted. But there are some posed in them.
Well, it's rather obvious the complaint hasn't come from a casual viewer, who has been shocked by what he or she has heard.

Look closely at the complaint. It's an exact transcript of a section of the show. It's obvious, someone has recorded the show, and watched it over and over, to get that much detail. Which means this person wasn't shocked by it at all.

It's just a malicious attempt by a rival channel to get a competitor fined.

If Ofcom can't see that, then it's about time they were dissolved, and the regulatory system passed onto another body.
