Yes i think originally Ofcom only complained to the Dutch regulator about the BS freeview channels, basically it was about the content and the BS freeview channels starting before Ofcom rules allow UK licensed adult chat phone in babe channels to start . (I don't think they complained about the content on Sky 906)

Ofcom rules state that adult chat Phone in Babe channels can't start on freeview before 12am.
Ofcom say they asked BS to voluntarily comply with Ofcom rules, Ofcom also stated that they could take the matter to the EU courts (there is a link somewhere on this forum to this) .
This was in early 2012, BS is still breaking Ofcom rules by starting at 10pm on freeview, so it seem BS have called Ofcom's bluff .

The Dutch regulator responded to the complaint by saying they were well aware of what BS were broadcasting on freeview from 10pm onwards, they said this "The Dutch legislator, hence also Nicam are of the opinion by that time children should be in bed and that adults should be able to decide what to watch and what not to watch, indeed Nicam does not participate in a discussion about morals or good taste when it comes to what adults can watch"
